HiCoe Terms of Service

These Terms of Service ("Terms") govern your access to and use of HiCoe, including its face-art and face-doodle feed, creative posting tools, short videos, remix features, themed events, live rooms, event chats, profiles, following features, direct messaging, search, reporting, blocking, moderation tools, and related services (collectively, the "Service"). By creating an account, accessing, or using HiCoe, you agree to these Terms.

1. Eligibility

You must be at least 13 years old, or the minimum age required to use an online service in your jurisdiction if that age is higher. If you are below the age of legal majority where you live, you may use HiCoe only with the permission of a parent or legal guardian where required by law.

2. Accounts and Security

You agree to provide accurate account information, keep it reasonably current, and protect your credentials. You must not impersonate another person, create accounts using information you are not authorized to use, access another account without permission, or circumvent account restrictions.

3. The HiCoe Service

HiCoe may provide features including:

• a feed for original face doodles, face-art looks, creative makeup, photos, short videos, and visual ideas;
• tools for creating posts and adding captions;
• remix previews and features for creating your own interpretation of eligible creative content;
• themed events, face-art challenges, and community sessions;
• live rooms and event-based chats;
• following features and mutual-follow direct messaging;
• search and discovery for creators, looks, videos, and community topics;
• profiles, reporting, blocking, moderation, and other safety tools.

We may add, modify, restrict, suspend, or discontinue features when reasonably necessary for legal, safety, security, technical, operational, or product reasons.

4. User Content

"User Content" means content you submit, upload, publish, transmit, stream, display, send, or otherwise make available through HiCoe, including face-art images, face doodles, makeup looks, photos, videos, captions, comments, direct messages, profile information, live-room contributions, event-chat content, remix content, and other creative material.

You retain ownership of rights you have in your User Content.

5. License to HiCoe

By making User Content available through HiCoe, you grant HiCoe a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and distribute that content solely as reasonably necessary to operate, secure, provide, and improve the Service, subject to applicable law and available privacy settings.

This license does not transfer ownership of your User Content to HiCoe. It generally ends when your User Content is deleted from active systems, except where continued retention or processing is reasonably necessary for backups, legal obligations, safety investigations, fraud prevention, dispute resolution, enforcement, or content already shared or remixed by others in a manner that cannot reasonably be withdrawn.

6. Rights and Permissions

You are responsible for User Content you share and represent that you have all rights, licenses, permissions, and consents necessary to make it available through HiCoe.

If content shows another person's face, appearance, voice, artwork, or private information, you should have a lawful basis and any permission required to post it. You must respect copyrights, trademarks, privacy rights, publicity rights, and other legal rights belonging to others.

7. Face Art and Creative Expression

Face art, makeup, costumes, visual references, symbols, text, and other creative elements must comply with these Terms and applicable law. You may not use creative content to harass, threaten, exploit, humiliate, impersonate, or unlawfully target another person or group.

You are responsible for deciding whether cosmetics, face paint, adhesives, accessories, or other materials shown by users are appropriate for you. HiCoe does not manufacture or certify products shown in user content and does not guarantee that a technique or product shown by another user is safe or suitable.

8. Remix Features

HiCoe may allow users to view remix previews or create new interpretations inspired by content made available for remixing. A remix must be your own lawful creative contribution and must respect applicable intellectual property, privacy, publicity, and other rights.

The availability of a remix feature does not grant permission to use third-party material outside the permissions provided through HiCoe or applicable law. Where controls are available, users are responsible for selecting appropriate remix settings for their content.

9. Themed Events

HiCoe may host or display themed events, creative challenges, sessions, or community activities. Additional event rules, eligibility requirements, deadlines, or participation conditions may apply and will form part of these Terms when you participate.

Unless expressly stated otherwise, participation does not guarantee prizes, promotion, recognition, exposure, or any particular result.

10. Live Rooms and Event Chat

Live rooms and event chats are intended for real-time creative discussion and community participation. You must treat other participants respectfully and comply with applicable rules.

You must not use live features to harass, threaten, stalk, intimidate, broadcast unlawful sexual or exploitative content, share another person's private information without authorization, coordinate illegal activity, scam users, distribute spam, or evade moderation.

11. Following and Direct Messaging

HiCoe may make direct messaging available only after two accounts follow each other. Mutual following does not create an obligation to communicate. Users may unfollow, block, report, or otherwise limit interactions using available controls.

Direct messaging may not be used for harassment, repeated unwanted contact, spam, fraud, threats, illegal solicitation, or unwanted sexual content.

12. Search and Discovery

HiCoe may surface eligible content through feeds, search, discovery, event pages, topic pages, and similar features. Search and discovery results may change over time and are not guaranteed to be complete, chronological, or ranked in any particular way.

13. Prohibited Content and Conduct

You may not submit, publish, transmit, promote, or engage in content or conduct that:

• is illegal, fraudulent, deceptive, or materially misleading;
• sexually exploits minors or contains child sexual abuse material;
• contains non-consensual intimate imagery or sexual exploitation;
• credibly threatens serious violence or promotes dangerous unlawful conduct;
• encourages self-harm or dangerous conduct likely to cause serious injury;
• constitutes targeted harassment, stalking, severe abuse, or unlawful discrimination;
• violates intellectual property, privacy, publicity, or other rights;
• reveals another person's sensitive or private information without authorization;
• contains malware, phishing, credential theft, malicious code, or similar cybersecurity threats;
• facilitates fraud, scams, spam, fake engagement, or deceptive schemes;
• otherwise violates applicable law or creates a serious safety risk.

14. Reporting, Blocking, and Moderation

HiCoe may provide tools for reporting posts, comments, live content, messages, or accounts and for blocking other users. We may review reports and take action when we reasonably believe content or conduct violates these Terms, community rules, law, or safety requirements.

Actions may include limiting visibility, removing content, restricting features, muting or removing participants from live rooms, disabling messaging, issuing warnings, suspending accounts, terminating accounts, preserving relevant evidence, or reporting matters to authorities where required or permitted by law.

We do not guarantee that all objectionable content will be detected, reviewed, or removed immediately.

15. HiCoe Intellectual Property

Except for User Content, the Service and its software, interfaces, graphics, logos, branding, design elements, text, and features are owned by or licensed to HiCoe and are protected by applicable intellectual property laws. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

16. Rights Complaints

If you believe content on HiCoe infringes your copyright, privacy, publicity, or other legal rights, contact hicoe.support@gmail.com and provide enough information for us to identify the content and understand your claim.

17. Prohibited Technical Conduct

You may not interfere with or overload the Service, bypass security or moderation controls, scrape or harvest data through unauthorized automated means, introduce malicious software, or use bots to create fake engagement or manipulate Service functionality.

18. Third-Party Services

HiCoe may rely on or link to third-party websites, software, services, infrastructure, or content. Independent third-party services may be governed by their own terms and privacy practices.

19. Suspension and Termination

You may stop using HiCoe at any time. Where account deletion functionality is available, you may request deletion through the Service or by contacting us.

We may restrict, suspend, or terminate access when we reasonably believe you materially or repeatedly violated these Terms, created a safety or security risk, exposed HiCoe or others to legal liability, or when restriction is reasonably necessary to comply with law. Where appropriate and legally required, we may provide notice or an opportunity to appeal.

20. Disclaimers

To the maximum extent permitted by applicable law, HiCoe is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, specific engagement results, or the accuracy, originality, quality, or suitability of content submitted by users.

21. Limitation of Liability

To the maximum extent permitted by applicable law, HiCoe and its operators, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the Service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

22. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless HiCoe and its operators from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Service, material breach of these Terms, or User Content that violates another person's rights. This section does not apply where prohibited by applicable consumer law.

23. Changes to These Terms

We may update these Terms to reflect changes in the Service, legal requirements, safety practices, or business operations. If changes are material, we will provide notice in a manner appropriate to the circumstances where required by law. Updated Terms will state a new effective date.

24. Governing Rules and Disputes

These Terms are subject to applicable laws and mandatory consumer protections that apply to your relationship with HiCoe. Nothing in these Terms removes rights that cannot legally be waived.

25. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
